Terms
of use:
Professional Queue, a
provider of web hosting, web design and other internet
related services has designed this section to help
professional Queue and its customers understand certain terms
and conditions, and it is intended to explain the clients'
rights and obligations when utilizing our services
Spamming:
The sending of unsolicited messages over the Internet is totally
prohibited. The term "spamming" includes, but is not
limited to, the sending of unsolicited bulk and/or commercial
message over the Internet or maintaining an open SMTP policy.
When and if a complaint is received, Professional Queue has the
discretion to determine from all of the evidence whether the
email recipients were from an "opt-in" email list.
Intellectual
Property Violations: Any violation of any person's
intellectual property rights, rights of privacy, rights of
publicity or other personal rights is prohibited. Professional
Queue is required by law to remove or block access to content
appearing on or through the Services upon receipt of proper
notice of copyright infringement
Export
Control Violations: Exporting encryption software over the
Internet or otherwise, to points outside the United States is
considered prohibited in all its forms.
Destructive
Activities and Distribution of Viruses: Professional Queue
prohibits the spreading of information regarding the creation
and sending of Internet viruses, worms, Trojan horses, pinging,
flooding, mail bombing, or denial of service attacks. Also,
activities that disrupt the use of or interfere with the ability
of others to effectively use the network or any connected
network, system, service, or equipment
Hacking:
Hacking and related activities is prohibited.
"Hacking" includes, but is not limited to, the
following activities: illegally or without authorization,
accessing computers, accounts or networks, penetrating or
attempting to penetrate security measures, port scans, stealth
scans, and other activities designed to assist in hacking.
Material
Containing Obscene Language and Pornography: Professional
Queue prohibits the use of all services to display, transmit,
advertise child pornography or the use of any obscene and/or
inflammatory language. Professional Queue is required by law to
notify law enforcement agencies when it becomes aware of the
presence of child pornography on, or being transmitted through,
the Services.
Misrepresentation
of Transmission Information: Forging, misrepresenting,
omitting, or deleting message headers, return mailing
information and/or Internet protocol addresses to conceal or
misidentify the origin of an message is prohibited.
Other
Illegal Activities: Engaging in activities that are
determined to be illegal, including advertising, transmitting,
or fraudulently charging credit cards, and pirating software is
prohibited.
Other
Activities: Engaging in activities, whether lawful or
unlawful, that Professional Queue determines to be harmful to
its subscribers, operations, reputation, goodwill, or customer
relations
Private Policy:
This section covers the
security and privacy of collected information from Professional
Queue customers
Client
Information: Information submitted from the client to
Professional Queue such as, name, address, or any contact
information is considered private, and will not be disclosed to
any 3rd party under any circumstances. Professional Queue will
protect the confidentiality of its customers' information,
account information and personal communications to the fullest
extent possible and consistent with the law and the legitimate
interests of Professional Queue, its partners, its employees and
other customers of Professional Queue's services.
Information
Maintenance: Information about clients that is maintained on
our systems is protected using industry standard security
measures. However, we cannot guarantee that the information
submitted to, maintained on, or transmitted from our systems
will be completely secure
Client Agreement:
This section deals with
the terms and conditions regarding the services such as design
hosting and other internet-related services rendered by
Professional Queue to the clients.
Definitions:
Design
involves creating or modifying visual elements of the site,
including scanning images, developing color themes and page
layout, and cross-checking site design in various browsers and
screen resolutions. Modifications will be completed as requested
one time without additional charge. Minor additions or deletions
will be performed periodically free of charge to said client.
Design changes which vary sharply from the originally approved
site design plan will be billed accordingly but will not be
executed without client consent. Such changes include creating a
new page, or adding a new feature to the site post client
approval.
Hosting
is the rental of disk space on the Professional Queue
web server. This is billed annually according to the amount of disk space
required by client's site.
Copyright
is the recognition of ownership of creative work. Any work
that is "fixed in a tangible medium of expression" is
copyrighted and protected. As such, permission must be granted
and fees must be paid if necessary prior to licensed legal use
of such work.
Payment:
Client agrees to pay
Professional Queue for services rendered upon execution. After the client’s approval no refunds of any kind
will be given. Professional Queue reserves the right to remove
web pages from viewing on the Internet until final payment is
made. Should collection activities become necessary, the client
agrees to pay all fees relating to said activity.
If client does not give approval of the web site design,
Professional Queue will make every effort to satisfy said
client. If said client does not wish to continue with their web
design and development project. Only the actual cost of the web
design services pertaining to mentioned website will be
refunded. The cost of i.e. shopping carts, domain registration
.. etc. purchased on behalf of the client will not be refunded
for any reason
All web hosting services are pre-paid on an annual basis. No refunds of any kind are given. Should you need to cancel your service with us, please notify us in writing prior to your annual statement due date.
Warranties
and liabilities:
Professional Queue
cannot guarantee that the functions of the web site will meet
the client's expectations of site traffic or resulting business.
In no event will Professional Queue or its sub-contractors be
liable to the client or any third party for any damages,
including any lost profits, lost savings or other incidental,
consequential or special damages arising out of the operation of
or inability to operate these Web pages or Web sites.
